A case settled Friday involved a funeral home in Queens, NY
A "plumber" installed a drain line for a back flow preventor on a small boiler, and on this 2" line, he installed an indirect air gap for the boiler's relief valve and also added a 3/4" PVC line for the AC unit
The 2" line penetrated an outside wall, and the "drip" went on the sidewalk.
I noted two code infractions.
1- PVC cannot be used on commercial buildings, including AC condensate
2- Even a clear water drain line cannot discharge onto the public street, including storm line from a leader.
The lawsuit involved a lady who slipped on the ice, broke her hip and ankle, and, of course, hurt her back and had a concussion.
At the pretrial meeting, the funeral home decided not to go to trial and settled the suit.
The installing plumber is very lucky so far as the job was a "self certification" meaning he inspected his own work and approved it.
If the Department of Buildings finds out, he will lose his self-certification privileges and possibly have his license revoked
