We've changed out to quieter low flow and even old "regular" toilets. We've opened the walls up, wrapped the 3.5" cast iron pipe with a sound insulating putty and then added more insulation from toilet and tub drains on the second floor to the basement....and virtually no improvement in the noise level.
It sounds like someone is standing on the second floor with a 5 gallon bucket and dumping down between the walls.
We are hearing this in the cast pipes throughout the house. All walls that contain drain pipe runs are framed at either 6" or 8" framing.
I need some suggestions......other than call the attorney
