The diverter is usually a "double seated" stem and if anything, such as a different sealing washer, prevents both seats from making contact with their mating surfaces it will do what you describe.
: I have a combo tub/shower in the master bath that uses a 3 stem setup (hot, cold and a diverter in between). The problem is when I turn the diverter valve to direct the water to the showerhead, I still get a good flow of water from the tub spigot. I have replaced the diverter valve and seat and get the same results. The house is a little over 30 years old and I think it's the original setup, but I have replaced stems and washers in the past. Any ideas? Thanks in advance!
