One solution would be to replace the diverter tub spout since it seems to be stuck.
Diverter spouts come in several styles, slip-on and threaded with either long or short position FIP fitting. Normally, the spout comes off and the proper adjustments are made for the installation of a new one. It is nice to have a selection of pipe nipples handy.
