Septic Tanks

My friends just bought a house. The septic system didn't pass the first test, then passed a second test. My friends had let the realtor and the owners know that they had no money for repairs. They signed for the house based on the second report. The day they got the keys they went to the house and there was contminants boiling up in their yard on a hill under the house above the septic system. Now they find that they need a completely new system. Were they defrauded and could the inspctor be held liable? The contract that they signed said that he wasn't liable, that the inspection only counted for the day of the inspection. Is this normal or legal?
