So long as your tub branch is vented properly, it doesn't matter. If your drawing is a vertical installation, some inspectors might have issue with your toilet piping arrangement.

I'm going to install a wye in my waste stack below the wye for the WC to introduce drain from my 2nd floor bath tub. I'm wondering if there is a code or other requirement (or recommendation) for the distance (dimension) below the WC wye that the wye for the bath tub drain should maintain.

Here's a pic of the plumbing for the toilet. The offset on the right goes to the closet bend and the one on the top goes to the vent stack. It's the original installation.
