Diverter problem?

Just installed a new Moen 82403 3-handle shower and tub valve fixture.

A small stream of water comes out of the tub spout when the center handle is set for shower. Is this normal for a new unit? I've seen this with old fixtures but didn't expect it from the new one.

The diverter assembly appears undamaged. The tub spout is IPS (if that matters). What besides the diverter would cause this and ought to be checked?

Bring it back to where you bought it and have them exchange the diverter. There may just be a peice of something stuck where it seals or it could be a deformed / damaged gasget.

It didn't seem normal but it was too late to call Moen and I thought they might not be available Monday either.
I'll post an update after a replacement diverter is installed.
 
Update

Another diverter installed yielded the same result. On the Moen help line I was told it is not supposed to completely shut off and a small stream out the tub spout is correct. The only thing we can figure is it is to let the water drain out of the shower line if you turn off the water but don't turn the diverter knob. Could that be?
