Our kitchen was remodeled. After new tile floors were installed, the base molding was cut and nailed into place. Problem was it was nailed into the pvc pipe that went from the second floor bath to the basement...which caused a leak. We hired a plumber that found the leak was due to 2 nails into the pipe. Is the person that installed the base molding responsible?

If you have a horizontal run of drain pipe along the bottom of the wall, then that is poor planning and there is no way for the finisher to know that the piping was installed like that. However it is more likely that you have a vertical run of piping which didn't have a 10c nail protection plate installed to guard against exactly what happened (or at least show that there is piping there), so I would say that the plumber is negligent.

Regardless of how the nail hit the pipe, unless the carpenter was told it was there, he would have no way of knowing about it. The nail could have been above any protection plate. BUT if he had to try putting the nail in a dozen times at that location before finally doing it, by avoiding the nail plate,and THEN hitting the pipe, then he would be responsible.
