Is it "legal" to install the garbage disposal on/off switch directly over the kitchen sink- up about 8-10inches?

Practical, no.

Thank you. We were told by an electrician that it was a code violation so were thinking of having it moved.

You say it is legal though. Are there different rules in different counties and states? I'm in Alexandria, Virginia.

Certainly could be. You'd have to check with your local code office.
Or you could ask him for a code citation for the violation.

Mine is in the cabinet so that you have to open the door to run it. Makes for no classic oops starts.
