Dishwasher air vent requirements

I am installing new granite counter tops and have to reinstall my dishwasher. The current installation utilizes an air vent next to the sink, where the disposal and the dishwasher hook into. My question is do I need to have this air vent? Apparently this is not required in Ohio (where my granite is coming from), but I live in KY am not sure about the requirements here.

BTW – a certified plumber will be taking care of this, but I have to make a decision to have a hole drilled in the granite first.

Not sure about KY but most other places require it and if they don't they should because it's the only thing that will keep raw sewage from potentially backing up into your dishwasher. And so you know, I have seen it happen way more than once.
 
The actual name of this device is a "dishwasher air gap"

A call to your local building inspector will answer your question.
