water coming from spout and showerhead

I recently updated out bathroom and installed all new walls and towels, we used the existing plumbing but when we installed the new tub fixtures we now have a problem, allthough we followed the manufactures specifications for measurements when we turn on the water we get water that comes out of the tub spout and the showerhead at the same time, we would like a solution that would not require us to rip out any of our brand new wall tile.

In other words, if you used PEX from the valve to the diverter, then you either open the wall or live with it. Assuming you did not install the valve upside down.

We used copper pipe, and have access to one side of the wall, however we are hoping for an easier solution to avoid tiping some tiles off and redrilling new holes

If you used copper pipe, then you should not have the problem, therefore there is something else wrong, but we cannot tell you what without seeing the actual installation.
 
Could just be a bad diverter. Try installing a new one and see if that fixes it.
 
when you pull the diverter up it only comes out of the showerhead (like it should) so it seems to be working fine
 
If it's still diverting water in the down position, there may be something stuck or broken in the diverter.

If you have a spout diverter, remove it. If that fixes the problem, then replace the diverter. If not, you'll have to go into more detail about the installation.
