Pressure balance valve required in Arizona...

My new tub filler with handshower dosent have anti scald feature. I did a brief review of scottsdale code (2006 IRC). The only part I could find was it was needed for tub and shower combination but nothing noted for tub only.
The tub I just ripped out didnt have a PBV but it also didnt have a hand shower wand.
Does anyone know if this is a code requirement?

When a shower is involved, yes, it is required in the national codes...local codes may differ.
